The authors show where evidence rules are commonly used and how the lawyer uses them to persuade the judge deciding evidentiary issues. The book does not address evidence from a historical, social policy, or comparative law perspective, nor does it critically analyze the existing rules or interpretative case law. Rather, it analyzes these rules functionally and shows how they apply in the courtroom and how lawyers can use the law as a functional tool to persuade judges. Each chapter has law and practice sections, with functional overviews of the Federal Rules of Evidence referring to major treatises and examples of their use before and during trials, how lawyers can make evidentiary objections, and how judges make rulings, based on actual federal and state cases.
